Subordinate Legislation

The Committee reports to the Parliament as follows—

Representation of the People (Post-Local Government Elections Supply and Inspection of Documents (Scotland) Amendment Regulations 2012 (SSI 2012/draft)

1. The Representation of the People (Post-Local Government Elections Supply and Inspection of Documents (Scotland) Amendment Regulations 2012 (SSI 2012/draft) was laid before the Parliament on 17 January 2012. The instrument is subject to the affirmative procedure.

2. These Regulations make provision about the fees to be charged for the supply of copies of marked copies of the electoral register and some lists, following a local government election. The fees are being reduced, to bring them into line with the fees charged for equivalent copy documents following elections to the UK Parliament and Scottish Parliament.

3. At its meeting on 8 February 2012, the Local Government and Regeneration Committee considered the instrument. The Committee took evidence on the instrument from the Minister for Local Government and Planning.

4. Derek Mackay MSP (Minister for Local Government and Planning), moved motion S4M-01904—

That the Local Government and Regeneration Committee recommends that the Representation of the People (Post-Local Government Elections Supply and Inspection of Documents) (Scotland) Amendment Regulations 2012 [draft] be approved.

5. The motion was agreed to.

The Scottish Local Government Elections Amendment Order 2012 (SSI 2012/draft)

6. The Scottish Local Government Elections Amendment Order 2012 (SSI 2012/draft) was laid before the Parliament on 17 January 2012. The instrument is subject to the affirmative procedure.

7. This Order amends the Scottish Local Government Elections Order 2011 (“the principal Order”). Article 2(2) amends article 5 of the principal Order to insert a further amendment to the Representation of the People (Postal Voting for Local Government Elections) (Scotland) Regulations 2007, in consequence of updated material in the principal Order. Article 2(3) amends rule 61 of Schedule 1 to the principal Order to provide that information relating to postal votes is to be treated in the same way as polling station information.

8. At its meeting on 8 February 2012, Committee considered the instrument. The Committee took evidence on the instrument from the Minister for Local Government and Planning.

That the Local Government and Regeneration Committee recommends that the Scottish Local Government Elections Amendment Order 2012 [draft] be approved.
