Report on Subordinate Legislation

The Committee reports to the Parliament as follows—

1. The Health Boards (Membership and Elections) (Scotland) Order 2013 [draft] was laid before the Parliament on 8 November 2013. The instrument is subject to the affirmative procedure.

2. This Order revokes the Health Boards (Membership and Elections) (Scotland) Act 2009 (Commencement No. 1) Order 2009, which commenced sections 1 to 3 of the Health Boards (Membership and Elections) (Scotland) Act 2009 in respect of Fife and Dumfries and Galloway Health Board areas for the purpose of piloting Health Board elections in those areas. This Order brings the pilot scheme to an end in terms of section 6 of the 2009 Act. The Order also makes incidental, consequential and saving provision.

3. At its 36th meeting 2013, held on 17 December, the Health and Sport Committee considered the Regulations.

4. The Committee noted that the Delegated Powers and Law Reform Committee had not made any comments on the instrument.

5. The Committee took evidence on the instrument from the Cabinet Secretary for Health and Well-being.

6. The Cabinet Secretary for Health and Well-being moved motion S4M-0 8580—

That the Health and Sport Committee recommends that the Health Boards (Membership and Elections) (Scotland) Order 2013 [draft] be approved.

7. The motion was agreed to.
